AT A GLANCE  To keep our prices fair and our business sustainable, our legal responsibility is limited to what you paid for the product. Disputes are handled through informal resolution first, then binding individual arbitration — not court or class actions — except where law says otherwise.

This section limits our liability and sets out how disputes are resolved. It is part of our Terms & Conditions. Please read it carefully, as it affects your legal rights.

Limitation of Liability

•    Our products are provided “as is.” To the fullest extent permitted by law, ADHD Proud and its owners, employees, contractors, and partners are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Site or products.

•    Our total aggregate liability for any claim will not exceed the amount you actually paid for the product(s) giving rise to the claim.

•    Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you. Nothing here limits liability that cannot be limited by law (e.g., for fraud or personal injury caused by our negligence where non-waivable).

Informal Resolution First

Most issues can be solved quickly. Before filing a formal claim, you agree to contact us at support@adhd-proud.com and give us 30 days to resolve the matter in good faith. Many disputes are resolved at this stage.

Binding Arbitration

•    If we can’t resolve a dispute informally, you and ADHD Proud agree that any dispute arising out of or relating to these Terms or your purchase will be resolved by binding individual arbitration administered by [ARBITRATION BODY] under its applicable rules, rather than in court, except as noted below.

•    Arbitration will take place in [GOVERNING STATE] or be conducted remotely where available. The arbitrator’s decision is final and enforceable in any court of competent jurisdiction.

•    Exceptions: either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or stop misuse of the Site.

Class Action Waiver

You and ADHD Proud agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.

Governing Law & Venue

These Terms and any dispute are governed by the laws of the State of [GOVERNING STATE], without regard to conflict-of-laws principles. To the extent any matter proceeds in court, you consent to the exclusive jurisdiction and venue of the state and federal courts located in [GOVERNING STATE].

Time to Bring a Claim

Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.
