Welcome to ADHD Proud. These Terms & Conditions (“Terms”) govern your access to and use of adhd-proud.com and your purchase of our products. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Eligibility & Accounts

•    You must be at least 18 years old to make a purchase, or have the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

•    If you create an account, you’re responsible for keeping your login secure and for all activity under your account.

•    You agree to provide accurate, current, and complete information at checkout.

Products, Pricing & Availability

•    We sell apparel and lifestyle products, including print-on-demand, made-to-order, custom, limited edition, and pre-order items. Product colors and prints may vary slightly from screen images due to display settings and the production process.

•    All prices are in [CURRENCY — e.g., USD] and may change at any time. We work hard to display accurate pricing and stock, but errors happen.

•    Pricing & typographical errors: if a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse any order placed for that product, even after an order confirmation, and to refund you in full.

•    Limited editions and drops may be available only while supplies last and may be limited per customer.

•    Pre-orders are charged at checkout and ship on the timeline shown on the product page; estimated dates may change.

Orders & Acceptance

Your order is an offer to buy. An order confirmation email acknowledges receipt but does not constitute acceptance. We may accept or decline any order, in whole or in part, and may limit or cancel quantities purchased per person, per household, or per order. We may refuse or cancel orders that we reasonably suspect involve fraud, reseller activity, or policy abuse.

Payments

•    Payments are processed by third-party providers including Shopify Payments, Shop Pay, and PayPal. By paying, you authorize us and our processors to charge your selected payment method for the total amount.

•    You represent that you are authorized to use the payment method provided. If a payment is reversed, charged back without cause, or fails, we may suspend fulfillment and recover amounts owed.

Promotions, Discount Codes & Gift Cards

•    Discount codes are for legitimate customer use, may not be combined unless stated, have no cash value, and may be limited per customer or order.

•    We reserve the right to void orders or codes obtained through fraud, manipulation, bots, code-scraping, unauthorized resale or sharing of codes, or other abuse, and to recover the value of improperly applied discounts.

•    Gift cards are non-refundable and cannot be redeemed for cash except where required by law.

Acceptable Use

You agree not to misuse the Site, including by: violating any law; infringing our or others’ intellectual property; using bots, scrapers, or automated tools to access the Site or hoard limited-edition stock; attempting to gain unauthorized access; submitting false information; engaging in fraudulent purchases, returns, or chargebacks; or posting unlawful, hateful, harassing, or harmful content.

Third-Party Apps, Links & Services

The Site uses third-party services and Shopify apps (for example, reviews, marketing, analytics, and fulfillment). We are not responsible for the content, policies, or practices of third-party sites or services, and your use of them is at your own risk and subject to their terms.

Intellectual Property

All content on the Site — including our name, logos, designs, slogans, graphics, and product artwork — is owned by or licensed to ADHD Proud and protected by intellectual property laws. See the Intellectual Property Protection section for details and our limited license terms.

Disclaimers

The Site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Our products are apparel and lifestyle goods and are not medical devices or treatments; see the Product Disclaimer.

Limitation of Liability

To the fullest extent permitted by law, ADHD Proud and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim. See the Limited Liability & Dispute Resolution section.

Indemnification

You agree to indemnify and hold harmless ADHD Proud from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

Force Majeure

We are not liable for delays or failures to perform caused by events beyond our reasonable control, including natural disasters, severe weather, pandemics or public-health events, war, acts of terrorism, labor disputes, carrier or supplier delays, internet or platform outages (including Shopify), and government actions.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of [GOVERNING STATE], without regard to conflict-of-laws rules. Disputes are subject to binding arbitration and a class-action waiver as described in the Limited Liability & Dispute Resolution section, which is incorporated here by reference.

Changes to These Terms

We may update these Terms at any time by posting a revised version with a new “Last Updated” date. Your continued use of the Site after changes means you accept the updated Terms.
